No Toe Jam & Earl in Sega Games?

Looks like there is a panic on Funkotron as Toe Jam & Earl as the two heroes won't be in Sonic & Sega All-Stars Racing.

Sega doesn't own the full rights to Toe Jam & Earl anymore, according to a representative from Sonic & Sega All-Stars Racing developer Sumo Digital.

A devout Sega fan wrote the company asking about why Toe Jam & Earl weren't in Sega Superstars Tennis and if they might be in the 2010 racing game.

"ToeJam and Earl were characters we did want to include in Sega Superstars Tennis," said Steve, the Sumo Digital representative. "Sega had looked into it, but it transpires that the rights to the characters actually belong to someone else. I know Sega tried to resolve this so we could include them – but this wasn’t successful. As such – though we again proposed their inclusion for Sonic and Sega All-Star Racing, it’s looking unlikely to happen at this stage."

Apparently the rights for the characters are still owned by the original creators, and after the financial failure of the Toe Jam & Earl Xbox game, Sega might not be too keen on working too hard to revive the duo.
